In terms of the order passed by this Court on 26.04.2023, Shri Ran Vijay Singh, learned counsel appears for the respondents and places on record the instructions received by him dated 01.05.2023, which clearly reveal that the appointment shall be carried out after observing Rule 16, 17, 18 & Rule 22 of the U.P. Basic Education (Teachers) Service Rules, 1981 as amended.

The instructions further state that the exercise is being carried out for preparation of the seniority list on district-wise basis and further steps shall be taken only after the preparation of the seniority list, in accordance with Rule 16, 17, 18 & Rule 22 of the 1981 Rules as well as the NCTE guidelines issued from time to time and not otherwise.

In view of the said statement and the instructions received, which are taken on record, the writ petition at this stage does not disclose any cause of action. However, in case of any violation of the instructions/undertaking given before this Court, the petitioner would be at liberty to approach this Court.

The writ petition is disposed off in above terms.
